These Terms of Service (hereinafter "Terms") govern access to and use of the Orphea platform (hereinafter "the Service"), operated by the Orphea team. By accessing the Service or creating an account, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease all use of the Service.
"Service" refers to the entire Orphea platform, including the website, progressive web application (PWA), APIs, and all associated services accessible via orphea.app or any custom domain.
"User" refers to any individual accessing the Service, whether or not they have an account.
"Account" refers to the User's personal space, created by connecting via a music streaming provider (Spotify, Tidal, Deezer, SoundCloud) or by email address.
"Generated Content" refers to music analyses, DNA visualizations, narrative descriptions, and any data produced by the Service from the User's listening data.
"Subscription" refers to the plan chosen by the User (Starter, Pro, or Artist) determining the level of access to Service features.
Orphea is a music analysis platform using artificial intelligence to reveal the deep characteristics of your music. The Service offers: advanced audio analysis (BPM, key, energy, danceability), musical DNA profile across 4 axes (Beat, Lyrics, Structure, Emotion), lyrics analysis and contextual annotations, track anecdotes and history, and discovery of similar non-mainstream tracks via Deep Resonance.
The Service interfaces with third-party music streaming platforms (Spotify, Tidal, Deezer, SoundCloud) to access metadata and audio characteristics of your tracks. Orphea does not host, distribute, or enable downloading of copyrighted music files.
Analyses produced by the Service use a combination of real data from streaming APIs and AI-generated estimates. Each metric is accompanied by a source indicator (✓ Verified, ⚡ Estimated, ? Unknown) for complete transparency.
To access the full features of the Service, the User must create an account by connecting via a supported music streaming provider (Spotify, Tidal, Deezer, SoundCloud) or via a valid email address with a magic link.
The User must be at least 16 years old to create an account. Users aged 13 to 15 must have verifiable consent from a parent or legal guardian, in accordance with the General Data Protection Regulation (GDPR) and applicable national laws.
The User is solely responsible for the security and confidentiality of their login credentials. Any access to the Service made through their account is deemed to have been performed by the User. In case of suspected unauthorized access, the User must immediately notify us via the Support page.
The User agrees to provide accurate and up-to-date information when creating and managing their account. Orphea reserves the right to suspend or delete any account containing manifestly false or fraudulent information.
The Service is available in several plans: Starter ($2.99/month — 10 AI analyses), Pro ($9.99/month — 100 AI analyses, advanced community features), and Artist ($19.99/month — 500 AI analyses, artist dashboard, promotional tools). A limited free version is also available.
Payments are processed securely by Stripe. Orphea never directly stores your banking information. By subscribing to a paid plan, you authorize Stripe to charge the corresponding amount on a recurring basis, according to the chosen billing period (monthly).
The User may cancel their subscription at any time from their account settings. Cancellation takes effect at the end of the current billing period, and the User retains access to paid features until that date. No refunds are issued for partially used periods, except as required by applicable law.
Orphea reserves the right to modify its pricing. Any modification will be notified to Users at least 30 days before taking effect. Users who do not wish to accept the new pricing may cancel their subscription before the effective date of the change.
The Service uses artificial intelligence models (including OpenAI and Qwen) to generate narrative analyses, audio metric estimates, and contextual descriptions. This content is provided for informational purposes and does not constitute certified musical expertise.
AI-generated analyses are clearly identified with an ⚡ AI badge. Orphea commits to never presenting AI estimates as verified data without clear indication of their source.
The User acknowledges that AI analyses may contain inaccuracies, approximations, or subjective interpretations. Orphea cannot be held responsible for decisions made based on these analyses.
AI analysis credits are limited according to the subscription plan. Credit usage is tracked monthly and reset at each billing period.
The User agrees to use the Service in compliance with applicable laws and these Terms. The following are specifically prohibited: any attempt to circumvent security measures, reverse engineer, or decompile the Service; use of automated scripts, bots, or any form of scraping; creation of multiple accounts to bypass free tier limits; resale, redistribution, or commercial exploitation of Generated Content without authorization; harassment, defamation, or any harmful behavior toward other users via community features.
In case of violation of these rules, Orphea reserves the right to suspend or terminate the User's account, without notice or compensation, and to take any technical measures necessary to protect the Service and its users.
The Service, including its source code, design, visuals, algorithms, and brand, is protected by French and international intellectual property laws. Any unauthorized reproduction, modification, or distribution is strictly prohibited.
Generated Content (analyses, DNA visualizations, narrative descriptions) is granted to the User under a personal, non-exclusive, and non-transferable license for strictly private use. The User may share their analyses on social media provided they credit Orphea as the source.
Analyzed musical content (titles, artists, artwork, lyrics) remains the exclusive property of their respective rights holders. Orphea uses this data solely within the scope of licenses granted by streaming APIs (Spotify, Tidal, Deezer, SoundCloud) and annotation services (Genius).
User contributions to community features (votes, comments, shares) are published under a license allowing Orphea to display and use them within the scope of the Service.
The Service interfaces with third-party platforms including but not limited to: Spotify (audio analysis and metadata), Tidal (high-fidelity streaming and metadata), Deezer (metadata and playlists), SoundCloud (metadata and listening data), Genius (annotations and lyrics), LRCLIB (synchronized lyrics), Wikipedia and MusicBrainz (historical context).
Access to these third-party services is subject to their own terms of use. Orphea does not control these services and cannot be held responsible for their availability, accuracy, or modifications. In case of modification or cessation of a third-party service, some Orphea features may be temporarily or permanently unavailable.
The User authorizes Orphea to access their data on these third-party platforms strictly to the extent necessary for the operation of the Service, in accordance with the OAuth permissions granted during connection.
The Service is provided "as is" and "as available." Orphea does not guarantee that the Service will operate uninterrupted, securely, or error-free.
Orphea shall not be liable for: service interruptions due to maintenance operations or circumstances beyond its control; data loss resulting from technical failure; inaccuracies in music analyses or AI estimates; any indirect, incidental, or consequential damages related to use of the Service.
To the fullest extent permitted by applicable law, Orphea's total liability to the User shall not exceed the total amount of subscriptions paid by the User during the 12 months preceding the claim.
Nothing in these Terms limits Orphea's liability in cases of intentional fault, gross negligence, or where the law prohibits such limitation.
The User may terminate their account at any time from the Service settings or by contacting support. Termination results in the deletion of their account and personal data within 30 days, in accordance with our Privacy Policy.
Orphea may terminate or suspend a User's account in case of violation of these Terms, fraudulent use, or at the request of a competent authority. The User will be notified of this decision by email, except in cases of emergency or legal obligation.
Upon termination, the User retains the right to request export of their personal data before final deletion, in accordance with the right to data portability under the GDPR.
These Terms are governed by French law. Any dispute relating to the interpretation or performance of these Terms shall be submitted to the exclusive jurisdiction of the competent French courts.
In accordance with consumer protection regulations regarding amicable dispute resolution, the User may freely use the mediation service offered by Orphea before taking legal action. The User may also use the online dispute resolution platform established by the European Commission (https://ec.europa.eu/consumers/odr).
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Orphea reserves the right to modify these Terms at any time. Substantial modifications will be notified to Users by email and/or by notification within the Service at least 15 days before taking effect.
Continued use of the Service after the modifications take effect constitutes acceptance of the new Terms. Users who do not accept the modifications may terminate their account under the conditions set out in Section 10.
The Service is currently offered as a beta version. This phase allows us to test features, collect user feedback, and improve the Service before its official release. By participating in the beta, the User acknowledges and accepts that the Service may contain bugs, errors, incomplete features, or temporary interruptions.
During the beta phase: data and generated analyses may be reset in case of a major database migration; some features may be added, modified, or removed without notice; performance may vary and does not necessarily reflect the final version; support is provided on a best-effort basis and response times may be longer.
The User is encouraged to report any bugs, suggestions, or feedback via the Feedback page of the Service. Constructive feedback directly contributes to improving the Service.
Orphea reserves the right to close the beta phase at any time. Beta users will be notified at least 15 days before the transition to the final version and may keep their account and data subject to acceptance of the updated Terms.
Beta users receiving free access during the beta phase are not guaranteed to retain this free access after the official release of the Service. Final pricing will be communicated before the end of the beta phase.
